Terms of sale

These terms apply to everything bought on this site. Placing an order means you accept them.

1. Who you are buying from

Deep Cut Sodas LLC sells the products on this site. Where these terms say "we", that is who they mean.

2. Prices

Prices are shown in USD and exclude sales tax and delivery unless the page says otherwise; both are calculated and shown before you pay. The price you are charged is the price displayed at the moment you complete checkout, recalculated on our servers from our own records. If a price on the site is obviously wrong, we may cancel the order and refund you in full rather than fulfil it, and we will tell you why.

Some products are listed as price on request. Those have no price yet and cannot be added to a basket. Asking about one is not an order and does not commit either of us to anything.

3. Placing an order

Your order is an offer to buy. The contract is formed when we send you a confirmation email, not when you click the button, and not when your card is authorised. If we cannot fulfil an order, we cancel it and refund it in full.

4. Payment

Payment is taken at checkout by a PCI DSS Level 1 payment processor. Your card details are entered into their hosted field and never reach our servers. We can see the last four digits and the outcome, and nothing else.

5. Delivery

Delivery times shown at checkout are estimates from the carrier, not guarantees. Risk in the goods passes to you on delivery. We are responsible for a parcel until it reaches the address you gave us; we are not responsible for an address you typed incorrectly, and we cannot redirect a parcel once it has shipped.

6. Cancelling and returning

See Returns for the full policy, which forms part of these terms. In short: unopened goods in resalable condition may be returned within 30 days of delivery. Cosmetics and personal-care products that have been opened or used cannot be returned for hygiene reasons, unless the product is faulty or was not what you ordered. Nothing in this paragraph affects your statutory rights.

7. Products, descriptions and claims

We describe each product as accurately as we can, including its size, its format and its ingredients. Photographs are of the actual product. Colours vary between screens.

Nothing on this site is medical advice and no product sold here is a drug. Cosmetic products are intended to cleanse, moisturise, scent or improve the appearance of skin and hair. They are not intended to diagnose, treat, cure or prevent any disease. If you have a skin or scalp condition, talk to a clinician. Patch-test anything new before general use, and stop using a product if it irritates you.

8. Individual results

Where a product page describes what a product does, that description is about the product, not a promise about you. Skin and hair differ, and results may vary from person to person.

9. Liability

Our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

10. If something goes wrong

Write to hello@example.com or call (973) 555-0100. We would rather fix it than argue about it.

11. Governing law

These terms are governed by the law of the State of New Jersey, and the courts of Essex County, New Jersey have jurisdiction.
